04 · Account Registration & Verification

Account Registration and Verification

4.1 Registration

To access most features of HomeSure, you must create a registered account. During registration, you agree to:

You must notify us immediately at support@homesure.com if you suspect any unauthorized use of your account. HomeSure will not be liable for losses resulting from your failure to protect your login credentials.

4.2 Identity Verification for Sellers

To protect buyers and maintain a trustworthy marketplace, all users who wish to post property listings must complete a mandatory identity verification process before their listings can be published. The following documents are required:

Government-Issued Photo ID
Passport, Driver's License, PhilSys National ID, SSS/GSIS ID, PRC ID, or Voter's ID. Must be current and valid.
Live Selfie with ID
A clear photo of you holding your government-issued ID next to your face. Both your face and the ID must be clearly visible.
Proof of Ownership / Authority
Transfer Certificate of Title (TCT), Deed of Absolute Sale, or a notarized authorization letter from the registered property owner.
Tax Declaration (if applicable)
Current Real Property Tax Declaration issued by the Municipality of Sta. Maria may be required for additional property validation.

4.3 Consent to Identity Data Processing

By submitting verification documents, you expressly consent to the following:

  • HomeSure may collect, store, and process images of your government-issued ID and selfie photograph for the sole purpose of confirming your identity as a property seller on the Platform
  • Your verification documents will be reviewed by authorized HomeSure administrators and will not be disclosed to other users, third parties, or advertisers
  • Submitted documents will be retained for a period not exceeding two (2) years from the date of last account activity, after which they will be securely deleted
  • HomeSure complies with Republic Act No. 10173 (Data Privacy Act of 2012) with respect to all personal data collected during the verification process

4.4 Verification Timeline and Re-Verification

Submitted documents are reviewed within 1–2 business days. You will receive a notification once your account has been approved or if additional information is required.

Verified seller accounts must undergo re-verification every six (6) months to maintain active listing status. Accounts with expired verification will have their listings temporarily hidden until re-verification is completed.

Submitting falsified, altered, or stolen identity documents is a serious violation of these Terms and may constitute a criminal offense under the Revised Penal Code and Republic Act No. 10175 (Cybercrime Prevention Act). Such accounts will be permanently banned and reported to the appropriate authorities.

05 · User Roles and Responsibilities

User Roles and Responsibilities

HomeSure operates with distinct user roles, each with specific permissions and responsibilities:

Buyer / Renter

May browse all active listings, save favorites, and contact sellers through the Platform's messaging system. Buyers are responsible for conducting their own due diligence before entering any property transaction. HomeSure does not verify buyer identity unless required by platform policies, but buyers must agree to these Terms upon registration and may not use the messaging system to solicit or facilitate fraud.

Seller / Landlord

Must complete full identity verification (Section 4.2) before posting listings. Sellers are solely responsible for the accuracy, completeness, and legality of all listing content they post. Sellers must sign the Platform's Memorandum of Agreement (MOA), ensure all property documents are authentic, update or remove listings when property status changes, and respond to buyer inquiries professionally and in good faith.

Administrator

Platform administrators review pending verifications, moderate listings and user reports, and manage user accounts. Admins are bound by strict confidentiality obligations and may not access user data beyond what is necessary for their assigned duties. All admin actions are recorded in the platform's audit trail.

Super Administrator

Has full platform access including admin account management, system configuration, and access to all audit logs. Super Admin actions are subject to the highest level of logging and accountability. Super Admins may not use their access to benefit themselves or third parties outside of their administrative duties.

06 · Property Listings and Authenticity

Property Listings and Authenticity

6.1 Listing Requirements

Verified sellers who post listings on HomeSure agree that all of the following conditions are met for every listing submitted:

  • The property described in the listing physically exists at the stated location within Sta. Maria, Bulacan
  • The seller holds legal ownership of the property or has express written authorization from the registered owner to list it for sale or rent
  • All property details — including address, type, price, unit size, available amenities, and photos — are accurate and not misleading
  • All photographs submitted are actual photos of the listed property. Stock images, photos of different properties, or digitally manipulated images are strictly prohibited
  • The listed price reflects the true and current asking price. Intentionally misleading pricing (i.e., advertising a price lower than what will actually be charged) is a violation of these Terms
  • Listings will be promptly updated or removed once the property has been sold, rented, or taken off the market

6.2 Required Documentation by Listing Type

The following property documents are required at the time of listing submission for admin review:

  • For Sale Listings: Transfer Certificate of Title (TCT) or Original Certificate of Title (OCT), current Real Property Tax Declaration, and a valid Tax Clearance or Tax Receipt
  • For Rent / Lease Listings: Proof of ownership (TCT or OCT) or a notarized authority-to-lease agreement signed by the registered property owner
  • For Condominiums: Condominium Certificate of Title (CCT) and the latest Homeowners Association (HOA) Clearance

6.3 Listing Review Process

All newly submitted listings undergo a review by HomeSure administrators before they are published and made visible to buyers. During review, admins may:

  1. Approve the listing and make it publicly visible
  2. Request additional documentation or corrections from the seller
  3. Reject the listing if it violates these Terms, contains inaccurate information, or raises authenticity concerns

Approved listings may still be removed at any time if subsequent reports or investigations reveal violations of these Terms.

HomeSure does not guarantee the legal title, physical condition, or fitness for purpose of any listed property. Buyers are strongly advised to conduct independent due diligence and consult a licensed real estate broker or legal professional before entering any transaction.

07 · Prohibited Conduct

Prohibited Conduct

The following activities are strictly prohibited on HomeSure and may result in immediate account suspension, permanent ban, and referral to law enforcement authorities. You agree not to engage in any of the following:

7.1 Fraudulent Listings and Misrepresentation

  • Posting listings for properties that do not exist ("ghost listings") or are not available for sale or rent
  • Listing a property that you do not own, have no legal authority to list, or that is already under an active exclusive contract with another agent or platform
  • Submitting falsified, edited, borrowed, or stolen property documents (TCT, deed, tax declaration, etc.)
  • Using stock photos, AI-generated images, or photographs of a different property to represent a listing
  • Advertising a deliberately lower price to attract inquiries, then demanding a higher amount upon contact (bait-and-switch tactics)
  • Creating duplicate listings for the same property across multiple accounts or listings
  • Misrepresenting the location, size, condition, or ownership status of any listed property

7.2 Identity Fraud and Impersonation

  • Submitting falsified, altered, or another person's government-issued ID or selfie during the verification process
  • Impersonating another individual, real estate professional, company, or government official
  • Creating multiple accounts to bypass a suspension or ban, or to artificially boost listing visibility
  • Sharing your account credentials with another person or allowing unauthorized individuals to use your account

7.3 Financial Scams and Unauthorized Transactions

  • Requesting advance payments, reservation fees, or any form of deposit through channels outside the agreed and transparent means (e.g., unofficial GCash, Palawan Express, or wire transfers without proper documentation)
  • Soliciting money or personal financial information from buyers under false pretenses
  • Using the messaging system to conduct phishing, smishing, or any type of financial fraud
  • Advertising properties at unrealistically low prices as a mechanism to collect personal data or payments from unsuspecting users

7.4 Harassment and Abuse

  • Sending threatening, harassing, abusive, discriminatory, or sexually explicit messages to other users
  • Using the platform to stalk, intimidate, or make another user feel unsafe
  • Submitting false or malicious reports against other users in bad faith

7.5 Platform Misuse and Security Violations

  • Attempting to gain unauthorized access to any account, database, or system component of the Platform
  • Using automated bots, scrapers, crawlers, or other tools to extract listing data without written consent from HomeSure
  • Engaging in any activity that overloads, disrupts, or degrades Platform performance
  • Reverse-engineering, decompiling, or otherwise attempting to extract the source code of the Platform
  • Violating any applicable local, national, or international law or regulation in connection with your use of the Platform
HomeSure takes fraud prevention seriously. Any conduct suspected to constitute a criminal offense — including estafa, identity theft, or cyber fraud — will be reported to the Philippine National Police (PNP), National Bureau of Investigation (NBI), or other relevant authorities, together with all available evidence.

08 · Reporting Fraudulent Activity

Reporting Fraudulent Activity

HomeSure provides multiple channels for users to report suspected fraudulent listings, scam behavior, and policy violations. We take every report seriously and investigate all valid complaints promptly.

  • A clear description of the suspicious activity or why you believe the listing or user is fraudulent

  3. 3
Action Taken: If the violation is confirmed, the listing is removed or the account is suspended within 48 hours. For serious offenses, the matter may be escalated and reported to authorities.
  4. 4
Reporter Notification: We will notify you of the outcome of your report when possible, subject to privacy considerations.

8.4 Reporter Protection and Report Abuse

HomeSure protects users who submit good-faith reports from retaliation. However, knowingly submitting false or malicious reports intended to harm another user's account or listings is itself a violation of these Terms and may result in the reporter's account being penalized.

09 · Intellectual Property

Intellectual Property

All content, design elements, interface components, and source code on the HomeSure platform — including but not limited to the logo, typography, color scheme, icons, and functionality — are the exclusive property of HomeSure and its developers, and are protected under applicable intellectual property laws of the Philippines and international treaties.

By submitting content to the Platform (including property photographs, descriptions, and other listing materials), you grant HomeSure a non-exclusive, royalty-free, worldwide license to display, reproduce, and use that content for the purpose of operating and promoting the Platform. You retain full ownership of all content you submit.

You represent and warrant that you own or have the right to use all content you submit, and that such content does not infringe upon the intellectual property rights of any third party.

Account Suspension and Termination

12.1 Suspension by HomeSure

HomeSure may suspend or restrict your account access — temporarily or permanently — if we reasonably determine that you have:

  • Violated any provision of these Terms of Service
  • Engaged in fraudulent, deceptive, or harmful activity affecting other users or the Platform
  • Submitted false identity or property documents during the verification process
  • Received multiple confirmed reports from other users
  • Failed to complete mandatory re-verification within the required period
  • Engaged in any activity that creates legal risk or liability for HomeSure

Temporary suspensions (7 to 30 days) apply to minor first-time violations. During a temporary suspension, your listings will be hidden but not deleted. Permanent bans apply to serious violations including fraud, identity theft, and repeated offenses. Permanently banned users may not create new accounts.

12.2 Appeal Process

If you believe your account was suspended in error, you may submit an appeal within 15 calendar days of receiving the suspension notice by emailing support@homesure.com with the subject line "Account Appeal." Please include your account details and a clear explanation of why you believe the suspension was unwarranted. HomeSure will review all appeals within 5–7 business days.

12.3 Termination by the User

You may terminate your account at any time through your Account Settings. A 30-day grace period applies before permanent deletion, during which you may reactivate your account. Upon permanent deletion, your listings, messages, and profile data will be removed from the Platform, subject to retention obligations outlined in our Privacy Policy.

Provisions that by their nature should survive termination — including intellectual property rights, limitation of liability, and dispute resolution terms — will remain in full force and effect after termination.
